Welcome to Penny. These Terms of Service ("Terms") govern your use of the Penny mobile application operated by Baig Innovations, LLC.

1. Acceptance of Terms

By accessing or using Penny, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the service.

2. Description of Service

Penny is a wellness tracking application designed to help users document pelvic health experiences, track patterns, and generate reports for healthcare provider appointments.

Penny is NOT a medical device. It does not diagnose, treat, cure, or prevent any disease or condition. Always consult qualified healthcare providers for medical advice.

3. Eligibility

3.1 Age Requirement

You must be at least 18 years old to use Penny.

3.2 Geographic Restriction

Penny is currently available only to users located in the United States.

4. User Accounts

4.1 Account Creation

You must provide accurate, current, and complete information when creating an account.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 Account Deletion

You may delete your account at any time through the app settings. Account deletion requires email verification.

5. Subscription and Payments

5.1 Free and Premium Tiers

Penny offers both free and premium subscription tiers. Free tier includes core tracking features with certain limitations. Premium tier unlocks additional features and removes limitations.

5.2 Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to their respective terms and payment policies.

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

5.4 Cancellation

You may cancel your subscription at any time through your device's app store settings. Upon cancellation, you will retain premium access until the end of your current billing period.

5.5 Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their policies.

5.6 Restore Purchases

If you have previously purchased a subscription, you can restore your purchase through the app's settings or subscription screen.

5.7 Subscription Plans & Pricing

Current pricing for Monthly and Annual subscriptions is available on the App Store and within the Penny app at the time of purchase.

Launch Pricing: Promotional pricing may be available for a limited time following the public launch. If you subscribe during a promotional period, your special rate will remain in effect for as long as you maintain an active, continuous subscription.

Standard Pricing: Standard rates apply to all other subscriptions. Prices are subject to change; however, we will provide at least 30 days' notice before any price increase affects your existing subscription.

5.8 Beta Users

Users who create accounts during the beta period may be eligible for promotional offers or early access benefits as announced at the time of signup.

  • Beta users may subscribe to premium at any time to lock in launch pricing
  • Specific promotional terms will be communicated during the signup process

Baig Innovations, LLC reserves the sole right to determine eligibility for any promotional offers. Eligible users will receive confirmation of their status and any applicable terms upon account creation.

5.9 Beta Disclaimer

During the beta period, Penny may contain bugs, incomplete features, or experience service interruptions. We appreciate your patience and feedback as we improve the app.

6. User Data and Privacy

Your use of Penny is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

Penny and its original content, features, and functionality are owned by Baig Innovations, LLC and are protected by copyright, trademark, and other intellectual property laws.

8. Prohibited Uses

8.1 General Prohibitions

You agree not to:

  • Use Penny for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the service
  • Use automated systems to access the service without permission
  • Impersonate any person or entity

8.2 Medical Misuse

You agree not to use Penny as a substitute for professional medical advice, diagnosis, or treatment.

8.3 User-Generated Content & Exports

You are solely responsible for the content of any notes, logs, or text you enter into Penny ("User Content"). You agree not to enter content that is illegal, threatening, or violates the rights of others.

Export Liability: When you use Penny's export features (e.g., generating PDFs for providers), you acknowledge that Baig Innovations, LLC acts only as a passive conduit for your data. We do not review, verify, or endorse your User Content. We are not liable for any legal consequences arising from the content you choose to document or share via Penny's export tools.

9. Disclaimers

9.1 Wellness Tool Disclaimer

PENNY IS A WELLNESS TRACKING TOOL, NOT A MEDICAL DEVICE. The information provided by Penny is for documentation and organizational purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or condition.

9.2 No Warranty

Penny is provided "as is" and "as available" without warranties of any kind, either express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, Baig Innovations, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Penny.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

11.2 Arbitration

Any dispute arising from these Terms or your use of Penny shall be resolved through binding arbitration in Orange County, Florida, in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action or representative action.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes via email or in-app notification at least 30 days before they take effect.
